The National Advertising Division (NAD) of BBB National Programs has recommended that Charter Communications discontinue or modify its claim that “Spectrum offers the fastest speeds in more neighborhoods than any other provider.” The recommendation comes after a challenge from AT&T Services, which argued that the claim was misleading.
The challenged claim appeared in three Spectrum internet advertisements featuring actress Michelle Monaghan. NAD determined that consumers could reasonably interpret the claim to mean that Spectrum offers both the fastest speeds and the widest availability in more neighborhoods than any other provider.
While Charter provided evidence showing that it offers faster speeds than competitors in more census blocks, zip codes, and broadband service locations, NAD found this evidence insufficient to support the broad claim of having both the fastest speeds and widest availability in more “neighborhoods.”
NAD concluded that Charter’s evidence did not adequately support the message conveyed in the advertisements and cautioned the company to modify future claims about “neighborhoods” to clearly disclose the basis of comparison.
Charter, in its advertiser statement, expressed disappointment with the NAD’s decision but stated that it will comply with the recommendations. However, the company maintains that it “strongly disagrees with NAD’s conclusion.”
This decision highlights the importance of accurate advertising in the competitive telecommunications market. Consumers rely on advertising claims to make informed choices, and NAD plays a crucial role in ensuring that those claims are truthful and substantiated.
