On September 30, 2025, the Federal Communications Commission (FCC) unanimously voted to initiate a proceeding aimed at speeding up the construction and modernization of wireless infrastructure, including cell phone towers, to support the rapid deployment of 5G and future 6G networks. The decision, formalized through a Notice of Proposed Rulemaking (FCC 25-67), seeks to overhaul existing regulations to streamline the deployment, densification, and upgrading of wireless networks across the United States. The move is part of the FCC’s broader effort to eliminate barriers that hinder the expansion of high-speed internet and advanced telecommunications technologies.
The rulemaking focuses on addressing state and local regulations that often delay or block the installation of wireless infrastructure. These regulations have been identified as significant obstacles to the rollout of 5G services, effectively creating prohibitions on network expansion in some areas. The FCC’s proposal will explore ways to clarify and, if necessary, preempt state and local rules that unlawfully restrict wireless network development. This includes examining restrictions on macro cell towers and other wireless facilities, as well as addressing issues like excessive permitting delays, unreasonable fees, and conditions based on aesthetic or similar criteria.
Building on the success of the FCC’s 2018 Small Cell Order, the new rulemaking aims to expedite state and local approvals for modifications to existing towers and base stations, as outlined in the Spectrum Act of 2012. The proposal will seek public input on creating a “rocket docket” process to resolve permitting disputes quickly, reducing bureaucratic bottlenecks that slow down infrastructure projects. By fostering a more efficient regulatory environment, the FCC hopes to encourage significant investment in network buildout and ensure that communities across the country can access cutting-edge wireless services without unnecessary delays.
