Amazon & Netflix Want Millions in Damages from the IPTV Service Set TV Now

Last year, a long list of studios, including Netflix and Amazon, sued the IPTV service Set TV Now. The lawsuit claims Set TV Now committed “mass infringement” of the content owned by the studios. The suit was filed in U.S. District Court in Central California, and the list of plaintiffs includes Amazon, Netflix, Disney, 20th Century Fox, Sony Pictures, Columbia Pictures, Universal, and Warner Bros.

The lawsuit recently moved into the discovery phase, but the owner of Set TV Now, Jason Labossiere, and its employee, Nelson Johnson, have both failed to respond to the deposition. The lawyer for Set TV Now has also received permission from the court to withdraw from the case after non-payment from Set TV Now.

The judge has entered a ruling of default against Set TV Now. This led ACE, who represents Netflix and Amazon to ask for a motion for default judgment against Set TV Now’s owners.

With this default judgment request Netflix, Amazon, and other Hollywood studios are asking for millions in damages from Set TV Now’s owners. This is on top of the $90 million judgment DISH has already won.

Set TV Now has shut down, but ACE said there is a “significant threat of continuing irreparable injuries to Plaintiffs.” This seems to be part of the argument pushing for the millions in damages.

We have to wait and see what the judge rules on the request for a default judgment.
